PHANGO ONLINE GRANTS ACCESS ON THE CONDITION THAT THE MEMBER ACCEPT AND ABIDE BY ALL OF THE TERMS, CONDITIONS AND GUIDELINES CONTAINED IN THIS TERMS AND CONDITIONS POLICY. BY REGISTERING FOR OR CONTINUING TO USE PHANGO ONLINE SERVICE, MEMBER ACKNOWLEDGES THAT MEMBER HAS READ, UNDERSTANDS AND AGREES TO BE BOUND BY ITS TERMS, CONDITIONS AND GUIDELINES. IF MEMBER DOES NOT AGREE TO ANY OF THE TERMS, CONDITIONS OR GUIDELINES, THE MEMBERS' SOLE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.

1. These Terms And Conditions shall bind the member to this Agreement and all other persons with access to the computer(s) owned, used or otherwise maintained by the applicant. Member represents that Member is at least 18 years old by registering as a member.

2. Phango Online's operating policy is referred to as member Terms And Conditions. The Document comprises the entire Agreement between Phango Online and Member, and supersedes any prior agreements between Member and Phango Online with respect to the subject matter of the Terms And Conditions. Phango Online may revise the Terms And Conditions at any time, and such revision is effective thirty (30) days after it is posted on the membership Terms And Conditions page of the Phango Online World Wide Web Site at the following address: http://www.Phango.com/ . The posted notice will include notice of the date of the last Terms And Conditions modification. Member agrees to review the Terms And Conditions periodically to be aware of such revisions. If any such revision is unacceptable the member may terminate membership as provided in Section 10 below. Member's continued use of the Phango Online service following the effective date of any such revision to the Terms And Conditions is conclusively deemed as acceptance of all such revisions.

3. Phango Online reserves the right to deny membership to or terminate the membership of any person for violation of Phango Online Terms And Conditions.

4. Members may access the services made available by Phango Online. Should those services be unavailable to Members from time to time, for any reason, the unavailability thereof shall not be a breach of this Agreement unless it continues without interruption for a period of seven (7) days.

5. Phango Online reserves the right at any time to impose limitations on or to cancel services to Member access to Phango Online services to the extent Phango Online determines, in its sole discretion, that such limitations or cancellations are necessary or appropriate.

6. Termination by the Member of the authority of Phango Online to charge Member's MasterCard/Visa/Discover/AMEX account, Checking Account or failure of the Member to otherwise properly pay for Phango Online membership, shall result in termination of Member's access as described pursuant to Section 10 - Cancellation.

7. Members shall select a unique username and password, which will permit access to Phango Online services by the Member. The Member shall not disclose the password to any other person, and is responsible for maintaining the confidentiality of the password. Concurrent use of one dial-up account is not permitted.

8. The Member shall comply with all policies and procedures adopted by Phango Online from time to time. Violation of Phango Online policies and procedures may, at the sole discretion of Phango Online, result in immediate termination of the Member's membership.

9. The Member agrees to provide us with accurate and complete registration and billing information, and agrees to keep that information updated at all times. Failure to do so constitutes a material breach of this Terms And Conditions. The Member will receive or have received an account name and a password. Phango Online retains ownership of all account names and licenses it to the Member on a limited, nonexclusive basis for the duration of the Member's account activation. The Member is responsible for all account activity, regardless of whether the Member is using the account or permitting another person to do so. Therefore, Member should supervise any account usage, especially children.

10. A one-time processing fee of $10.00 is assessed at the beginning of service. A Member's Service date is defined as the date either Monthly or yearly that a Member's account becomes due. In Monthly and yearly service accounts should be paid no later then the day before the service date to avoid interruption in service. The Member shall continue as a Member to Phango Online until the Member terminates such membership. A Member must notify Phango Online in writing at contact@phango.com prior to service date for cancellation to take effect before the next billing date. A Member terminating Service prior to their next service date shall not be entitled to a refund of the unused portion of any membership fee payment. Any Account found in default will be terminated on the date payment is due. It is the Responsibility of the Member to ensure that all billing information is kept up to date to avoid interruption in service. Any changes in billing status should be reported in writing to contact@phango.com.

11. WARRANTY DISCLAIMERS; LIMITATIONS OF REMEDIES. (A) Member understands that Phango Online does not operate or control the Internet in any way, and that all merchandise, information, and services offered or made available or accessible on or through Phango Online services are offered or made available or accessible by third parties who are not affiliated with Phango Online. The Member assumes total responsibility and risk for his/her use of Phango Online services. Phango Online MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER (INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR NON-INFRINGEMENT, OR THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) Phango Online and its officers, employees, agents, and volunteers shall not be liable for any cost or damage arising either directly or indirectly from Member's use of Phango Online.

12. Maintaining a continuous connection by artificial means while away from the computer is strictly prohibited. Phango Online reserves the right to terminate a connection lasting more than 4 continuous hours.

13. Any violation or abuse of the Terms And Conditions by the Member will result in cancellation of services.
